Mak verbindt in haar onderzoek een rechtstheoretisch perspectief met rechtsvergelijkend staatsrechtelijk onderzoek en empirische analyse (o.a. surveys, interviews). Centraal in haar onderzoek staat het functioneren van de rechtsstatelijke instituties (wetgever, uitvoerende macht, en in het bijzonder de rechterlijke macht) in moderne Westerse rechtsstaten in een veranderende juridische context.

Van 2008-2011 verrichtte zij met een Veni-subsidie van NWO onderzoek naar de veranderende rol van hoogste rechters in Westerse landen onder invloed van de globalisering van recht en rechtssystemen. Dit onderzoek mondde uit in de monografie Judicial Decision-Making in a Globalised World: A Comparative Analysis of the Changing Practices of Western Highest Courts (Oxford: Hart Publishing, 2013). In mei 2016 ontving zij een Vidi-subsidie van NWO voor een vijfjarig onderzoek naar de ontwikkeling van rechtspraakculturen binnen de Europese Unie.

Mak studeerde rechten in Rotterdam en Parijs. Zij promoveerde in 2008 aan de Erasmus Universiteit Rotterdam. Van januari 2014 tot en met mei 2016 was Mak in Rotterdam bijzonder hoogleraar Empirische studie van het publiekrecht en Directeur van de Erasmus Graduate School of Law.

Zij is bestuurslid van de Vereniging voor Wijsbegeerte van het Recht. Ook is Mak lid van de Utrecht Young Academy, een onafhankelijk groep onderzoekers aan de Universiteit Utrecht die als doel heeft om kritische perspectieven op de academie, beleid en de maatschappij uit te wisselen.

Prof. dr. Elaine Mak is a professor of Jurisprudence at Utrecht University.

Her research connects a legal-theoretical perspective with studies in comparative constitutional law and empirical analysis (inter alia surveys, interviews). In her research, she focuses on the functioning of the institutions of government (legislature, executive branch, and in particular the judiciary) in Western liberal democracies in an evolving legal context.

Between 2008-2011, she conducted research regarding the changing role of highest courts in Western countries under the effects of the globalisation of law and legal systems. This research was financed with a Veni grant from the Netherlands Organisation for Scientific Research (NWO) and culminated in the monograph Judicial Decision-Making in a Globalised World: A Comparative Analysis of the Changing Practices of Western Highest Courts (Oxford: Hart Publishing, 2013). In May 2016, she was awarded a Vidi grant by NWO for a five-year research project regarding the development of judicial cultures in the European Union.

Mak studied law in both Rotterdam and Paris. She received her PhD at the Erasmus University Rotterdam in 2008. From January 2014 until May 2016 Mak was Professor of Empirical Study of Public Law in Rotterdam as well as Director of the Erasmus Graduate School of Law.

She is a member of the board of the Netherlands Association for Philosophy of Law. Furthermore, Mak is a member of the Utrecht Young Academy, an independent group of researchers from Utrecht University that aims to exchange critical perspectives on academia, policy, and society in Utrecht and beyond.
